General Terms and Conditions
§ 1 Scope
These General Terms and Conditions (GTC) apply to all contracts concluded between kobosil.me Development, c/o IP-Management #8351, Ludwig-Erhard-Str. 18, 20459 Hamburg (hereinafter "Provider") and the customer (hereinafter "Customer") for the purchase of digital products via the website addp.dev.
These GTC apply exclusively. Deviating conditions of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.
§ 2 Conclusion of contract
The presentation of products on the website does not constitute a legally binding offer, but an invitation to place an order.
By clicking the purchase button and completing the payment process via PayPal, the Customer submits a binding offer to purchase the respective product. The Provider accepts the offer by providing the digital download.
§ 3 Prices and payment
All prices are quoted in Euro (EUR) and include the applicable statutory value-added tax (VAT). For supplies to businesses within the EU holding a valid VAT ID, invoicing is carried out under the reverse-charge mechanism without VAT being shown.
Payment is processed via PayPal. The purchase price is due upon completion of the payment process.
§ 4 Delivery
Delivery is exclusively via digital download. After successful payment, the Customer receives immediate access to download the purchased product.
§ 5 License
The Provider grants the Customer upon purchase a perpetual, personal, non-transferable license to use the purchased product.
Licenses are available in the following tiers:
- Private - Use by 1 person (non-commercial)
- Commercial - Commercial use by 1 person
- Commercial Team - Commercial use by up to 5 people
Distribution, reproduction, or sharing of the product beyond the licensed user scope is not permitted.
§ 6 Updates
The purchase price includes updates for a period of 12 months from the date of purchase. After this period, the Customer may optionally purchase an update renewal.
There is no entitlement to specific features or functionalities in future updates.
§ 7 Warranty
Statutory warranty rights apply. For digital products, the Provider is liable for the product meeting contractual requirements at the time of delivery.
The Customer is obliged to report defects immediately upon discovery.
§ 8 Liability
The Provider is fully liable in cases of intent and gross negligence. In cases of slight negligence, the Provider is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable, contract-typical damage.
Liability for damages arising from injury to life, body, or health remains unaffected.
§ 9 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the withdrawal policy .
Important notice: The right of withdrawal expires prematurely if the Provider has begun performance of the contract (provision of the download) after the Customer has expressly agreed and confirmed awareness of the loss of the right of withdrawal (§ 356 para. 5 BGB).
§ 10 Data protection
Information on the processing of personal data can be found in the privacy policy .
§ 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes is the Provider's registered office.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory regulation.
